Mann Electronics Service Agreement
By registering for or using our telemetry, monitoring, or related technical services, you agree to be bound by this Service Agreement (“Agreement”).
1. Scope of Services
We will provide the services described in the relevant order, quotation, registration form, or service description, including telemetry hosting, monitoring, dashboard access, technical support, and related configuration services where applicable.
2. Customer Responsibilities
You are responsible for providing all information, access, credentials, hardware, and cooperation reasonably required to enable setup and ongoing operation of the service. You remain responsible for the lawful operation, configuration, and suitability of your own systems and devices.
3. Data and Privacy
We will process personal and device data only as necessary to provide the service, manage your account, support the service, and comply with legal obligations. Our processing of personal data is governed by our Privacy Policy.
4. Fees and Payment
Fees for the service, if any, will be set out in the accepted quote, order, registration form, or subscription plan. Payment is due in accordance with those terms. If any invoice is not paid on time, we may suspend or terminate access to the service.
5. Service Availability
We aim to provide a reliable service, but we do not guarantee uninterrupted access, zero downtime, or that all data will always be available unless expressly agreed in writing.
6. Warranties and Liability
We provide the service using reasonable skill and care, but we do not guarantee that the service will be error-free or fit for every purpose. To the extent permitted by law, we exclude implied warranties and limit liability for indirect or consequential losses.
7. Ownership and Intellectual Property
Unless otherwise agreed in writing, all intellectual property rights in our software, platform, dashboards, tools, templates, and related materials remain our property. You retain ownership of your own data and content that you upload or provide to the service.
8. Termination
We may suspend or terminate the service if you fail to pay, breach this Agreement, or where required for legal or security reasons. On termination, access to the service may be withdrawn and data may be deleted or archived in accordance with our retention policies.
9. Confidentiality
Each party will keep confidential any non-public information disclosed by the other party and use it only for the purpose of this Agreement.
10. Governing Law
This Agreement is governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
